What is a Notary Public in England & Wales?

Unfortunately, this is a common question.  There are practising solicitors we come across who are surprised to discover that notaries exist in England and Wales. 

There are more than two types of lawyer here.  A Notary Public is in fact a member of an independent third branch (in fact being the oldest branch) of the English legal profession.  There are less than 1,000 notaries in England and Wales.   While Notaries are lawyers in their own right and can practise in all areas of English law save court proceedings, most but not all Notaries Public tend to also practice as solicitors.   The practice of  a Notary Public is however separate from that of a solicitor and is not controlled by the Solicitors Regulation Authority nor subject to the rules affecting solicitors.  The appointment and regulation of Notaries is instead controlled by the Faculty Office of the Archbishop of Canterbury

A Notary Public's work has historically dealt with the authentication and execution of documents for use abroad.  As more and more UK residents nowadays choose to marry outside the UK, to accept employment abroad, to engage in business abroad, and to buy property in other countries, the need for and scope of notarial services only increases.  These can relate to a wide range of activities including overseas property transactions, administration of the affairs of people who have died, commercial transactions in other countries, court proceedings and immigration.

The reason for the long-standing reliance by other countries on Notaries Public is that unlike the duties that solicitors owe to their clients, when a Notary Public carries out his public duty he is said to have a responsibility to the transaction itself.  In recognition of this, the seal and signature of an English Notary Public is recognised not only by the Foreign and Commonwealth Office, various High Commissions and Embassies in England but throughout the world regardless of the legal systems adopted in various countries.


It should be noted that in England and Wales, notarial acts or instrument have been accorded greater weight as authentic evidence and may be considered for use with documents in this country.



"Under English Law "All notarial acts and instruments may be received in evidence without further proof as being duly authenticated in accordance with the requirements of law unless the contrary is proved".

Civil Procedure Rules - Rule 32.20

Kevin is normally available between 9am and 5pm Monday to Fridays. So that you do not make a visit to his office when he is not available please telephone (01934 852542) in advance for an appointment.

Kevin normally sees people at his office in Langford.  Where commercial or private clients are unable to come to his office because of schedules, disability or for other special reason, he is willingly make arrangements to see them in their offices or business premises, at another convenient meeting place.  In such cases, the relevant documents may need to be stamped and recorded upon Kevin s return to his office following which these shall be returned to you.
